This week I focused on the legal and political aspects of our application as part of our individual research assignments.
One of the major legal concerns in food donation is the potential liability if someone becomes ill from donated food. In Australia, although there is no overarching federal law for food donation liability, each state and territory provides protections for donors. These laws generally protect individuals, businesses, and organizations from civil claims as long as the food was safe and properly handled. However, this protection does not apply in cases of negligence or intentional harm (Beckmann et al., 2022).
Additionally, the Food Standards Code (FSC) is a national regulatory framework applied by all state and territory governments. It sets the rules for food safety, labeling, storage, and handling, and it applies to online platforms like Food Next Door that facilitate food redistribution (Department of Health, Victoria, 2015).
From a data protection perspective, the platform must comply with the Australian Privacy Act 1988. This includes adhering to 13 Australian Privacy Principles (APPs), which require the collection and use of personal data to be transparent, minimal, and secure. These rules are especially important when handling sensitive user data such as dietary preferences or allergies (Attorney-General's Department, 2024).
Australia also enforces the Notifiable Data Breaches (NDB) scheme, which has been in effect since 2018. Under this regulation, if a data breach occurs, the platform is legally required to notify affected users and report it to the Office of the Australian Information Commissioner (OAIC, 2019).
Lastly, as Food Next Door is a digital platform that will involve third-party delivery services, it may fall under future digital economy regulations concerning platform conduct, worker rights, and consumer protections.
This legal research helps shape how we build our platform to ensure it is both safe and compliant with Australian laws.
